1. Introduction

At Bizly we deeply value your privacy. This policy explains in detail how ARK PLATFORMS (owner of Bizly) collects, uses, stores, and protects your data when you use our platform to create companies in the United States, United Kingdom, and Spain. We want you to clearly understand what information we handle, for what purpose, and what your rights are.

2. Personal Data We Collect

We collect personal information to operate Bizly correctly: full name, email address, phone number, password, physical address, tax data, and details of the company you wish to create (name, sector, address, number of employees, etc.). This information is necessary to conduct legal procedures in the corresponding jurisdictions, verify the identity of the user, and ensure that the company formation is carried out in compliance with local regulations.

3. Financial and Billing Information

To process payments and issue invoices we need certain financial data, such as your credit or debit card details, banking information, or company billing data. These data are managed through external payment providers that comply with high security standards (e.g., PCI-DSS). At Bizly we ensure that we do not store unencrypted card data and that we only share with third parties what is strictly necessary to complete secure transactions.

4. Technical and Usage Data

When using our platform, we automatically collect technical information via logs and analytics: your IP address, operating system, browser type, screen resolution, pages visited, clicks, session time, and other interactions within Bizly. These data allow us to improve performance, detect errors, optimize user experience, and protect ourselves against malicious uses or security threats.

5. Purpose: Company Creation Process

All data we collect for registration and use of Bizly is used to manage the constitution of companies in authorized countries. This involves the preparation and submission of necessary legal documentation, identity verification, communication with advisors, presentation of data to local authorities if applicable, and monitoring of the entire process to ensure that your company is created in accordance with relevant regulatory requirements.

6. Purpose: Personalization and Platform Improvement

We use usage data to better understand how you interact with Bizly and thus optimize flows, improve usability, prioritize the most useful functions, and adapt the experience to your needs. We may also use the information to suggest relevant improvements, adapt the interface based on your preferences, and make the process more efficient for you as an entrepreneur.

7. Communication with Our Users

We may send you notifications by email, within the app, or through other authorized channels to inform you about the status of your business process, changes in our policy, product updates, reminders, invoices, or security alerts. These communications are a fundamental part of keeping you aware of everything happening with your account and your company.

8. Sharing Data with Third Parties

We do not sell your data to third parties for marketing purposes. We only share information with third parties when specifically necessary: for example, with payment providers, lawyers, tax advisors, or verification entities, all under contracts that ensure confidentiality and a level of security equivalent to ours. We may also share data if the law requires us to or to protect our rights and those of other users.

9. Security and Protection

We have implemented technical (such as encryption in transit and at rest), organizational (access control, permissions), and physical security measures to safeguard data. We conduct regular audits, penetration tests, and monitoring to detect possible vulnerabilities. In case of a security breach, we will activate our response protocols, inform you, and take corrective measures immediately.

10. Data Retention

We retain your personal data as long as necessary for the purposes for which they were collected (company constitution, billing, legal obligations). Once they are no longer necessary, we securely delete or anonymize them, to protect your privacy and reduce risks of unnecessary storage.

11. Your Rights Over Your Personal Data

You have the right to access your data, request its rectification, deletion, or limit its use. You can also withdraw your consent for its processing. To exercise any of these rights, contact us at info@arkplatforms.co.uk. We will respond in accordance with applicable legislation, within a reasonable timeframe.

12. Consent for Treatment

By registering and using Bizly you explicitly accept that we collect and process your data as described in this policy. If you withdraw your consent, some functionalities may cease to be available. We will always inform you if this occurs so you can make an informed decision.

13. Use of Cookies and Similar Technologies

We use cookies, tracking tags, and other technologies to improve your experience, remember your preferences, and analyze platform usage. You can configure your cookies in your browser to reject them, although some Bizly functions may not work correctly if you do. We always respect your consent regarding these technologies.

14. Activity Logs and Audit

We keep records of user actions for security and audit purposes: accesses, changes, transactions, company creation, among others. These records help detect suspicious behavior, resolve disputes, and ensure that our operations are transparent and traceable.

15. Fraud Prevention and Identity Verification

We perform identity verification processes ("Know Your Customer" – KYC) to prevent fraud, money laundering, and illegal activities. We may request official documents, proof of address, information on the source of funds, or any other necessary evidence according to the jurisdiction. Depending on each case, we could reject an application if controls are not satisfactorily completed.

16. How We Notify You of Risks or Breaches

If we detect a vulnerability, unauthorized access, or any security breach, we commit to notifying you as soon as possible with clear information about what happened, what data might be affected, and what measures you should take. Furthermore, we will explain how Bizly is responding to mitigate risk and prevent repetition.

17. Periodic Audits and Reviews

We perform internal and external audits to evaluate compliance with our privacy and security policies. These audits verify that controls are adequate, that data processing procedures are correct, and that the platform remains secure against new threats.

18. Retention of Legal Documents

We retain relevant legal documentation (forms, contracts, receipts) for the time required by current legislation in each country. Once the legally required periods are met, these documents can be archived, anonymized, or destroyed securely, as appropriate.

19. International Transfers

Since Bizly operates in multiple jurisdictions (USA, UK, Spain), your data may be transferred between different countries. We ensure that these transfers comply with data protection regulations (such as GDPR), using adequate legal mechanisms like standard contractual clauses and appropriate security measures.

20. Policy Modifications

We may update this privacy policy when legal, technological, or operational changes occur. We will publish the most recent version on Bizly and notify you if changes significantly affect the treatment of your data. We encourage you to review this policy periodically to stay up to date.

21. How to Exercise Your Rights

To exercise your rights (access, rectification, deletion, restriction, or withdrawal of consent), you can contact us at info@arkplatforms.co.uk. We will verify your identity to protect your information and will process your request as soon as possible, respecting applicable legal deadlines.

22. Subcontractors and Processors

We work with external providers (processors) for payments, analysis, security, notifications, and more. These providers are contractually bound to use your data only for the purposes Bizly defines, to keep them secure, and to comply with data protection laws. We verify that their security measures are equivalent to ours.

23. Merger, Acquisition or Reorganization

If ARK PLATFORMS, EUROPE LIMITED merges, is acquired, or reorganizes, your data may be transferred to the new entity. We commit to ensuring your rights over that data remain under the same protection conditions. If you do not agree with the new terms, you will be able to exercise your rights under this policy (e.g., requesting deletion of your data).

24. Limitation of Liability

Although we apply high standards of security and protection, we cannot guarantee absolute security. In case of an incident, our liability will be limited as permitted by law. We are not responsible for indirect damages, loss of opportunity, or reputation if recommended good practices (such as using secure passwords) are not followed.

25. Applicable Law and Jurisdiction

This policy is governed by the laws of the United Kingdom (where ARK PLATFORMS, EUROPE LIMITED is registered) and by applicable data protection regulations based on your location, such as the GDPR in the EU. In case of dispute, the parties will submit to the competent jurisdiction established in our terms and conditions.

26. Separation from Other Services

If you decide to integrate Bizly with other third-party services (accounting, CRM, advisory), those services may have different privacy policies. Bizly is not responsible for data processing performed by those third parties, so we recommend reviewing their conditions before allowing integrations.

27. Transparency and Traceability

We maintain internal mechanisms to ensure that the use of your data is always traceable and auditable. Any significant action on your information can be logged and monitored by our team, reinforcing accountability and trust in our platform.

28. Ethical Use of the Platform

We are governed by ethical principles: your data is not exploited for unclear or discriminatory purposes. ARK PLATFORMS and Bizly are committed to fair, transparent, and respectful use of information, avoiding practices that could harm users or infringe their rights.

29. Service Evolution

As Bizly evolves, it is possible that we launch new functions, integrations, or improvements that require collecting other types of data. We will always inform you before collecting new data and will ask for your permission when necessary to comply with new purposes.

30. Security Training and Awareness

At ARK PLATFORMS we train our team in data protection and good security practices. All employees who have access to personal data receive regular training to ensure they handle information responsibly and in accordance with our privacy policy.

31. Privacy Impact Assessments

For new functionalities that involve sensitive data processing, we perform Privacy Impact Assessments (PIA) to identify risks and mitigate them before launching the feature. This ensures that the protection of your data is considered from the design phase ("Privacy by Design").

32. Final Commitment

At ARK PLATFORMS and Bizly we are completely committed to the privacy and security of your data.
