Acceptable Use Policy

1. Introduction and Purpose
This Acceptable Use Policy ("AUP") governs your use of the services, website, and platform provided by ARK PLATFORMS, EUROPE LIMITED, operating as Bizly ("Bizly," "we," "us," or "our") at https://bizly.arkplatforms.eu. This AUP is designed to protect Bizly, our users, and the broader internet community from irresponsible or illegal activities. By accessing or using our services, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of your account, legal action, and reporting to relevant authorities. We reserve the right to investigate suspected violations and to cooperate with law enforcement agencies in prosecuting users who violate this policy.
2. Scope and Applicability
This AUP applies to all users of Bizly's services, including but not limited to: (a) Customers who purchase company formation services, marketplace orders, or other paid services; (b) Registered users who create accounts on our platform; (c) Visitors who browse our website or access our content; (d) Third-party service providers, partners, and affiliates who interact with our platform; (e) Any other individuals or entities that access or use our services in any capacity. This policy applies to all activities conducted through or in connection with our services, including but not limited to account creation, content submission, communications with other users or our support team, use of our API or developer tools, and any other interactions with our platform.
3. Prohibited Activities - Illegal Conduct
You may not use our services for any illegal, unlawful, or criminal purposes, including but not limited to: (a) Money laundering, terrorist financing, fraud, embezzlement, or any other financial crimes; (b) Tax evasion, tax fraud, or structuring transactions to avoid reporting requirements; (c) Sanctions violations, including conducting business with sanctioned individuals, entities, or countries; (d) Drug trafficking, weapons trafficking, human trafficking, or other serious crimes; (e) Child exploitation, child pornography, or any activities that harm minors; (f) Intellectual property infringement, including copyright, trademark, or patent violations; (g) Identity theft, impersonation, or fraudulent misrepresentation; (h) Hacking, unauthorized access to computer systems, or distribution of malware; (i) Any other activities that violate applicable laws, regulations, or legal obligations in any jurisdiction. We have zero tolerance for illegal activities and will report any suspected criminal conduct to law enforcement authorities.
4. Prohibited Activities - Fraudulent or Deceptive Practices
You may not engage in fraudulent, deceptive, or misleading practices, including but not limited to: (a) Providing false, inaccurate, or misleading information during account registration, company formation, or any other process; (b) Using false identities, stolen identities, or impersonating another person or entity; (c) Submitting forged, altered, or fraudulent documents or identification; (d) Creating multiple accounts to circumvent restrictions, abuse promotions, or engage in fraudulent activities; (e) Engaging in chargeback fraud or payment fraud; (f) Making false claims, misrepresentations, or deceptive statements to us, our partners, or other users; (g) Manipulating or falsifying information to obtain services, benefits, or advantages to which you are not entitled; (h) Engaging in pyramid schemes, Ponzi schemes, or other fraudulent investment schemes. Fraudulent activities undermine trust in our platform and will result in immediate account termination and potential legal action.
5. Prohibited Activities - Abuse of Services
You may not abuse, misuse, or exploit our services in any way, including but not limited to: (a) Using our services to facilitate or support illegal activities, even if the use itself is not illegal; (b) Attempting to circumvent security measures, access controls, or usage limitations; (c) Reverse engineering, decompiling, or disassembling our software or systems; (d) Using automated tools, bots, scrapers, or scripts to access or interact with our services without authorization; (e) Overloading, flooding, or launching denial-of-service attacks against our infrastructure; (f) Attempting to gain unauthorized access to our systems, networks, or data; (g) Interfering with or disrupting the operation of our services or the experience of other users; (h) Exploiting bugs, vulnerabilities, or errors in our systems for personal gain or to harm others; (i) Using our services in a manner that violates the terms of service of third-party providers or partners. We invest significant resources in maintaining secure and reliable services, and abuse will not be tolerated.
6. Prohibited Activities - Harmful or Offensive Content
You may not submit, upload, transmit, or display content that is harmful, offensive, or inappropriate, including but not limited to: (a) Content that promotes, incites, or glorifies violence, terrorism, or harm to individuals or groups; (b) Content that is hateful, discriminatory, or harassing based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics; (c) Content that is sexually explicit, pornographic, or obscene; (d) Content that promotes or facilitates illegal activities, including drug use, gambling, or other prohibited conduct; (e) Content that is defamatory, libelous, or that invades the privacy of others; (f) Content that contains viruses, malware, or other harmful code; (g) Spam, unsolicited advertising, or promotional content; (h) Content that infringes on the intellectual property rights of others. We are committed to maintaining a safe and respectful environment for all users.
7. Prohibited Activities - High-Risk Business Activities
You may not use our services to form companies or conduct business in certain high-risk industries or activities without prior approval and enhanced due diligence, including but not limited to: (a) Cryptocurrency exchanges, initial coin offerings (ICOs), or other virtual currency businesses; (b) Online gambling, casinos, sports betting, or other gaming activities; (c) Adult entertainment, escort services, or sexually oriented businesses; (d) Firearms, ammunition, explosives, or weapons sales; (e) Tobacco, vaping products, or cannabis businesses (where legal restrictions apply); (f) Pharmaceutical sales, especially controlled substances or prescription medications; (g) Multi-level marketing (MLM), network marketing, or similar business models; (h) Money services businesses, including money transmission, currency exchange, or check cashing; (i) High-risk financial services, such as payday lending or debt collection; (j) Any business that operates in a legal gray area or that has a high risk of regulatory scrutiny. If you wish to use our services for any of these activities, you must contact us in advance for approval and provide additional information and documentation.
8. Prohibited Activities - Sanctions and Export Control Violations
You may not use our services in any manner that violates international sanctions, export controls, or trade restrictions, including but not limited to: (a) Conducting business with individuals, entities, or countries that are subject to sanctions by the United Nations, European Union, United Kingdom, United States, or other relevant authorities; (b) Forming companies or conducting transactions that benefit sanctioned parties; (c) Exporting or re-exporting goods, services, or technology in violation of export control laws; (d) Engaging in activities that support or facilitate sanctions evasion; (e) Providing services to entities that are owned or controlled by sanctioned parties; (f) Operating in or conducting business with countries subject to comprehensive sanctions or embargoes. We screen all customers and transactions against sanctions lists and will refuse service to any party that appears on such lists or that we believe may be engaged in sanctions violations.
9. Prohibited Activities - Intellectual Property Violations
You may not use our services in any manner that infringes on the intellectual property rights of others, including but not limited to: (a) Using trademarks, logos, or brand names that you do not own or have permission to use; (b) Forming companies with names that infringe on existing trademarks or that are confusingly similar to well-known brands; (c) Copying, reproducing, or distributing copyrighted content without authorization; (d) Using our services to sell counterfeit goods, pirated software, or other infringing products; (e) Violating patent rights, trade secrets, or other proprietary rights; (f) Using our platform to facilitate or support intellectual property infringement by others. We respect intellectual property rights and will respond to valid takedown notices and infringement claims in accordance with applicable laws.
10. Account Security and Responsibility
You are responsible for maintaining the security of your account and for all activities that occur under your account. You must: (a) Choose a strong, unique password and keep it confidential; (b) Enable two-factor authentication (2FA) if available; (c) Not share your account credentials with others; (d) Notify us immediately if you suspect unauthorized access to your account; (e) Use security features such as passkeys or WebAuthn when available; (f) Regularly review your account activity and report any suspicious transactions or activities; (g) Keep your contact information up to date so we can reach you about security issues; (h) Log out of your account when using shared or public computers. You are liable for any unauthorized use of your account that results from your failure to maintain adequate security. We are not responsible for losses resulting from unauthorized access to your account due to your negligence.
11. Compliance with Laws and Regulations
You must comply with all applicable laws, regulations, and legal obligations in all jurisdictions relevant to your use of our services, including but not limited to: (a) Laws governing company formation, corporate governance, and business operations in the jurisdiction where your company is formed; (b) Tax laws, including registration, filing, and payment obligations; (c) Employment laws, labor laws, and worker protection regulations; (d) Data protection and privacy laws, including GDPR, CCPA, and other applicable regulations; (e) Anti-money laundering (AML) and counter-terrorist financing (CTF) laws; (f) Consumer protection laws and regulations; (g) Industry-specific regulations applicable to your business activities; (h) Import/export laws and customs regulations; (i) Environmental laws and regulations; (j) Any other laws or regulations applicable to your business or activities. You are solely responsible for understanding and complying with all legal requirements, and we are not liable for your failure to do so.
12. Truthful and Accurate Information
You must provide truthful, accurate, complete, and current information at all times when using our services. This includes: (a) Personal information provided during account registration; (b) Company information, including company name, business purpose, ownership structure, and beneficial owners; (c) Identity verification documents and supporting documentation; (d) Financial information, including source of funds and business revenue; (e) Contact information, including email addresses, phone numbers, and physical addresses; (f) Responses to our requests for additional information or clarification; (g) Updates to any information that changes over time. Providing false or misleading information is a violation of this AUP and may result in account termination, refusal of service, and reporting to authorities. You must promptly notify us of any changes to your information to ensure our records remain accurate and up to date.
13. Cooperation with Investigations
You must cooperate fully with any investigations, audits, or inquiries conducted by Bizly, regulatory authorities, or law enforcement agencies. This includes: (a) Responding promptly to requests for information, documentation, or clarification; (b) Providing access to records, documents, and other materials as requested; (c) Participating in interviews or meetings as necessary; (d) Not destroying, altering, or concealing evidence or information relevant to an investigation; (e) Not interfering with or obstructing investigations; (f) Maintaining confidentiality regarding investigations when required; (g) Complying with legal obligations such as subpoenas, court orders, or regulatory demands. Failure to cooperate with investigations may result in account suspension or termination, legal action, and reporting to authorities. We take our compliance obligations seriously and expect the same from our users.
14. Respectful Communication
When communicating with our support team, other users, or any representatives of Bizly, you must: (a) Be respectful, courteous, and professional; (b) Not use abusive, threatening, harassing, or offensive language; (c) Not make discriminatory or hateful remarks; (d) Not engage in personal attacks or insults; (e) Provide clear and accurate information about your issue or request; (f) Be patient and understanding, recognizing that our team is working to assist you; (g) Not spam or repeatedly contact us with the same issue without allowing time for a response; (h) Not impersonate others or misrepresent your identity or authority. We strive to provide excellent customer service, but we will not tolerate abusive or disrespectful behavior. Users who engage in such behavior may have their accounts suspended or terminated.
15. Third-Party Services and Integrations
If you use third-party services or integrations in connection with our platform, you must: (a) Comply with the terms of service and acceptable use policies of those third-party services; (b) Not use third-party services to circumvent restrictions or limitations in our AUP; (c) Ensure that your use of third-party services does not violate any laws or regulations; (d) Not use third-party services to engage in prohibited activities as defined in this AUP; (e) Understand that we are not responsible for the actions, policies, or practices of third-party services; (f) Not hold us liable for any issues, damages, or losses arising from your use of third-party services. We may integrate with various third-party services to enhance our platform, but you are responsible for your use of those services and for ensuring compliance with all applicable terms and policies.
16. Reporting Violations
If you become aware of any violations of this AUP or any illegal, fraudulent, or abusive activities on our platform, you must report them to us immediately. You can report violations by: (a) Contacting our support team at info@arkplatforms.co.uk; (b) Using the reporting features available on our platform (if applicable); (c) Providing detailed information about the violation, including evidence or documentation if available; (d) Cooperating with our investigation into the reported violation. We take all reports seriously and will investigate them promptly. We may also report violations to law enforcement or regulatory authorities as appropriate. Users who report violations in good faith will not face retaliation or adverse action from us.
17. Consequences of Violations
Violations of this AUP may result in one or more of the following consequences, depending on the severity and nature of the violation: (a) Warning or notice of violation; (b) Temporary suspension of account or services; (c) Permanent termination of account and access to services; (d) Forfeiture of fees paid or services rendered; (e) Reporting to law enforcement, regulatory authorities, or other relevant agencies; (f) Legal action to recover damages, costs, or losses incurred as a result of the violation; (g) Cooperation with law enforcement investigations or prosecutions; (h) Blacklisting or banning from future use of our services; (i) Public disclosure of the violation (in cases of serious or egregious conduct). We reserve the right to determine the appropriate response to violations based on the circumstances, and our decision is final. Repeat violators or those who engage in serious violations will face the most severe consequences.
18. No Liability for User Conduct
We are not responsible or liable for the conduct, activities, or content of our users. You acknowledge and agree that: (a) We do not endorse, support, or approve of any user conduct or content; (b) We are not responsible for verifying the accuracy, legality, or appropriateness of user-submitted information or content; (c) We are not liable for any damages, losses, or harm resulting from user conduct or content; (d) You use our services at your own risk and are solely responsible for your interactions with other users; (e) We have no obligation to monitor user conduct or content, but we reserve the right to do so; (f) We may remove content or suspend accounts at our discretion, but we have no obligation to do so. While we take steps to enforce this AUP and maintain a safe platform, we cannot guarantee that all users will comply with this policy or that all prohibited activities will be prevented or detected.
19. Monitoring and Enforcement
We reserve the right to monitor, review, and investigate user activities, content, and communications to ensure compliance with this AUP and to protect our platform, users, and the public. This may include: (a) Reviewing account information, transaction history, and usage patterns; (b) Monitoring communications between users or between users and our support team; (c) Analyzing content submitted or uploaded to our platform; (d) Using automated tools, algorithms, or manual reviews to detect violations; (e) Conducting audits or investigations of specific accounts or activities; (f) Cooperating with law enforcement or regulatory authorities in investigations. We will conduct monitoring and enforcement activities in accordance with applicable laws and our Privacy Policy. We may take action based on our monitoring activities, including suspending or terminating accounts, removing content, or reporting violations to authorities.
20. Amendments to This Policy
We reserve the right to update, modify, or amend this Acceptable Use Policy at any time to reflect changes in our services, legal requirements, industry standards, or for other operational reasons. When we make material changes to this policy, we will: (a) Post the updated policy on our website with a new "Last updated" date; (b) Notify registered users via email (if we have your email address on file); (c) Display a notice on our website or in your account dashboard. Changes to this AUP will take effect immediately upon posting unless otherwise stated. Your continued use of our services after changes are posted constitutes your acceptance of the updated policy. 21. Interpretation and Enforcement
This Acceptable Use Policy should be interpreted broadly to protect Bizly, our users, and the public from harmful, illegal, or abusive activities. The examples of prohibited activities provided in this policy are illustrative and not exhaustive. We reserve the right to determine, in our sole discretion, whether conduct violates this AUP, even if the specific conduct is not explicitly listed. We may enforce this policy selectively, and our failure to enforce any provision in a particular instance does not waive our right to enforce it in the future. This AUP is part of and should be read in conjunction with our Terms of Service. In the event of any conflict between this AUP and our Terms of Service, the Terms of Service will prevail unless this AUP explicitly states otherwise.
